MetricMash provides Producer Price Index (PPI) data by Commodity and covers more than 2,000 products and end uses. The PPI for a commodity measures the price changes received by domestic producers for their output before they reach the consumer. This information was gathered from the Bureau of Labor Statistics and organized for efficient access and consumption. Use this data to anticipate inflation, forecast future price changes for business and consumers, compare input and output cost, escalate purchase and sales contracts and inventory valuation. This dataset is updated monthly.

METRICMASH LLC - MICROSOFT AZURE END-USER LICENSE AGREEMENT

MetricMash LLC's End-User License Agreement (hereinafter known as "EULA") is a legal agreement between You (either an individual or a single entity, and if a corporation, "You" shall include your employees, agents and contractors) and MetricMash LLC for the MetricMash LLC content (hereinafter known as the "Licensed Content") which you have selected via Microsoft's Windows Azure Marketplace DataMarket service ("Windows Azure Marketplace DataMarket"). By downloading or otherwise using or accessing the Licensed Content, You agree to be bound by the terms of this EULA and to utilize the Licensed Content only in accordance with this EULA. This EULA represents the entire agreement concerning the Licensed Content between You and MetricMash LLC, and it supersedes any prior proposal, representation, or understanding between the parties.

PROVISION OF SERVICES
The Licensed Content is being licensed to You, not sold, for the duration of the subscription which has been selected within Windows Azure Marketplace DataMarket (the "Term"). Nothing in the EULA constitutes a waiver of MetricMash LLC rights under U.S. or international copyright law or any other federal or state law.

GRANT OF LICENSE.
The Licensed Content is licensed to You solely for Your own personal use. You further agree that You shall comply with all applicable laws in connection with Your use of the Licensed Content.

LIMITATIONS

  • The Licensed Content as it exists in its orignal published structure, shape and form by MetricMash LLC may not be sublicensed, redistributed, syndicated or used for any commercial purposes, or otherwise made available to any third parties.
  • You may not use the Licensed Content in conjunction with any material or service which is obscene, pornographic, defamatory, or otherwise illegal.

    TERMINATION
    The EULA and your right to use the Service will automatically terminate if you fail to comply with any material provision of this EULA. MetricMash LLC may terminate the EULA at any time by delivering notice to You.

    NO WARRANTIES
    MetricMash LLC expressly disclaims any warranties with respect to the Licensed Content. The Licensed Content is provided "AS IS," "WITH ALL FAULTS," and "AS AVAILABLE" without any express or implied warranty of any kind, including but not limited to any warranties of merchantability or fitness for a particular purpose. MetricMash LLC does not warrant or assume responsibility for the accuracy or completeness of the Licensed Content, the accessibility of the Licensed Content within Windows Azure Marketplace DataMarket, or the frequency/timeliness of the Licensed Content as accessed via Windows Azure Marketplace DataMarket. MetricMash LLC does not warrant or assume any responsibility for the functionality or availability of Windows Azure Marketplace DataMarket.

    LIMITATION OF LIABILITY

  • The use of the Licensed Content is at Your sole risk. In no event shall MetricMash LLC be liable for any direct, indirect, special, incidental or consequential damages (including, without limitation, lost profits, business interruption, or lost information), or other damages based in contract, tort or otherwise, arising out of the use of, or inability to use, the Licensed Content, or any element thereof, even if MetricMash LLC has been made aware of the possibility of such damages. MetricMash LLC shall have no liability whatsoever with respect to Your use of Windows Azure Marketplace DataMarket or with respect to functionality, availability, or any other aspect of Windows Azure Marketplace DataMarket.
  • In no event shall MetricMash LLC be liable for any failure or unavailability of the Licensed Content due to any act of God, fire, natural disaster, accident, act of government, shortage of materials or supplies, strikes or other organized labor action, significant failure of the Internet, terrorist activity, act of third parties, or any other case beyond the reasonable control of MetricMash.

    INDEMNIFICATION BY YOU
    If You use or distribute the Licensed Content in violation of this EULA, You agree to indemnify, hold harmless and defend MetricMash LLC from and against any and all claims, liability, loss, damage, cost and expense (including reasonable attorneys' fees and litigation costs), arising out of or relating to such unauthorized use or distribution of the Licensed Content.

    SEVERABILITY
    If any part of this License is held invalid or unenforceable, the remaining provisions of this EULA shall be unimpaired and remain in full force and effect.

    GOVERNING LAW AND JURISDICTION, JURY TRIAL WAIVER
    You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, province or territory determined solely by MetricMash LLC to resolve any legal matter arising from this EULA or related to your use of MetricMash LLC. THE PARTIES HERETO WAIVE TRIAL BY JURY WITH RESPECT TO ANY MATTERS ARISING UNDER OR RELATING TO THIS EULA and agree that the prevailing party or parties in any such litigation shall be entitled to recover from the other party all costs and expenses, including without limitation reasonable attorneys' and paralegals' fees incurred by such party in connection with such litigation.

    CHANGES
    MetricMash LLC reserves the right to change any part of this EULA, with or without notice, from time to time. You agree to regularly review this EULA, and your continued use of the Licensed Content after the effective date of such changes will constitute acceptance of and agreement to any such changes.
